General

These terms and conditions will apply to all transactions placed online or by phone with Herbert Sports. Please read carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights.

By using this site you are agreeing to these terms and conditions.

Orders

We are pleased to accept orders by any of the following methods. Online transaction via secure server or by phone. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Switch, Maestro Solo and Paypal . If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

The web price includes VAT at 20% where applicable.

Delivery

Herbert Sports will despatch your order within one or two working days of it being placed, subject to stock levels. Please note that Special Delivery items are also subject to a one or two day order processing time. The standard delivery option normally takes 3-7 working days (Mon - Fri). If you live in a far away location in the UK please allow an extra couple of days for delivery. We use Royal Mail and Parcel Force for our UK deliveries. If there is going to be a delay or the item you have ordered is unavailable for any reason we will let you know. All quoted delivery times are based on standard working days i.e. Mon - Fri (excluding public holidays etc). Orders sent by Special Delivery service or recorded delivery will require a signature on receipt. Please ensure that someone is present at the delivery address to sign for the order. Herbert Sports cannot accept responsibility for non-delivery of items when a signed for service is not used or for late delivery due to postal strikes or other factors beyond their control.

Herbert Sports reserves the right to amend the delivery option on orders where an incorrect delivery option has been selected without notice but in all cases you will be informed of amendments by email.

Details of delivery costs for the 3-7 day service are given next to each product on our site. In most cases 3-7 day delivery is FREE within mainland UK.

Next working day (24 hour) delivery up to 30kgs = £7.95

Delivery to outside mainland UK

Please note that there will be a £6 charge for deliveries to the following postcodes and that delivery may take a little longer than the standard 3 – 7 days. We are unable to offer the next day delivery service to these areas:

IM - Isle Of Man, BT - Belfast, IV - Inverness, PH - Inverness, PA - Renfrewshire, KY - Kirkcaldy, KW - Orkney Isles. TR20,21,22,23 - Truro, HS - Isle Of Lewis, ZE - Shetland, GY - Guernsey, JE - Jersey

International deliveries

The charge for international deliveries depends on the country of destination. Please email us with your address and we will let you know the cost and delivery times.

Returns and exchanges

You have the right to cancel your order at any time within 7 days of placing it. If the goods have already been despatched they must be returned to us with their packaging and in their original condition within 14 days for refund of the purchase price excluding any delivery charge.

If you are not completely satisfied with your purchase it can be returned within 30 days of purchase for exchange with an alternative item or for a refund of the purchase price. All purchases are covered by a 30 day exchange or refund guarantee. Your statutory rights are unaffected. To return an item please send it to the address below enclosing a note giving your order ID (printed on the packing note), listing the items you wish to return, and let us know if you would like an exchange or refund. Returns older than 30 days will not be accepted unless agreed by Herbert Sports in advance. You will be responsible for the item or items until they reach us. For your own protection, we suggest you use a secure delivery method, which requires a signature upon delivery.

Products must be returned in their original condition including tags & packaging. If goods are not returned in the condition in which you received them we reserve the right to refuse such returns.

Upon receipt of the returned goods we will refund you any money you have paid us for the product(s) being returned, or exchange for an alternative item if required. Any original delivery costs are non-refundable under normal circumstances. The return postage cost of the goods is at your own expense unless agreed in advance by Herbert Sports.

Products, prices and content

Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely as possible those of the actual product due to technical limitations, some colours may vary.

All prices are shown in pound sterling (£)  and are inclusive of UK VAT  at the current rate unless clearly stated.

Prices, product descriptions and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions.

Any information displayed on our web site(s) or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our web site is updated regularly.

We reserve the right to alter our prices and specifications without notice.

Ownership of goods

All items supplied to the customer remain the property of Herbert Sports until final payment of all sums owing in respect of those goods has been received in full by us.

Comments and complaints

Privacy policy

We will collect and store any personal data that you may volunteer whist using our services, e.g. placing an order, joining our e-mail newsletter or entering a prize draw or competition.

The type of information that we will collect will include - Your title and name, known address, contact telephone numbers, e-mail address, order and payment details. Details may be forwarded securely to other parties in order to fulfil this order only. These will include delivery and payment partners.

We will collect and store information about you to allow us to firstly, process and fulfil any order requirements and secondly to provide you with information to keep you up to date on products, services or promotions we run from time to time. We may also use your information to contact you for market research purposes by email, phone or mail. You can opt out of this at any time, either by writing or emailing us.

Individuals registering their details or subscribing to the newsletter online may do so on the understanding that they are aware of the intended purpose for the collection of data. An opt-out option is available by clicking on the unsubscribe link in the newsletter we may send you.

In addition to the Information that you supply to us, information and data may be automatically collected through the use of cookies. Cookies are small files stored within your web browser from our website. Cookies do not collect personal information about you nor do they allow us to access your computer in any way. All information is collected lawfully and in accordance with the Data Protection Act 1998 .
